Terms & Conditions
1. Acceptance of Terms
Agreement to These Terms
By accessing or using Platsana (the "Application"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Application.
These Terms incorporate by reference Platsana's Privacy Policy, Refund Policy, and Acceptable Use Policy, each of which forms part of the agreement between you and Platsana. In the event of any conflict between these Terms and any incorporated policy, these Terms shall prevail.
2. Platform Intermediary
Platsana as a Platform
Platsana provides software that enables yoga studio owners and managers ("Studio Users") to manage their business operations, including facilitating payments from their end customers ("End Consumers") to the studio through the Application.
Platsana is not a party to any transaction, agreement, or dispute between a Studio User and their End Consumers. The contract for any class, membership, or service purchased through the Application exists solely between the studio and the End Consumer. Platsana assumes no liability for the fulfilment, quality, or legality of any such transaction.
3. Payment Facilitation
Processing Payments on Your Behalf
Platsana facilitates payments from End Consumers to Studio Users through Stripe Connect. By using the payment features of the Application, Studio Users agree to Stripe's Connected Account Agreement in addition to these Terms. Platsana does not hold, control, or take custody of funds at any point in the payment process.
Studio Users are solely responsible for ensuring that all charges applied to End Consumers are accurate, authorised, and compliant with applicable law. Any disputes arising from transactions between a studio and its customers are the sole responsibility of the Studio User.
4. Studio User Responsibilities
Your Obligations as a Studio Owner
Studio Users are responsible for all activity that occurs under their account. This includes ensuring accurate representation of services offered to End Consumers, compliance with applicable consumer protection and privacy laws, and the handling of any refund requests, complaints, or disputes raised by their customers.
Platsana shall not be liable for any loss, claim, or damage arising from a Studio User's failure to meet these obligations.
5. Disclaimer of Warranties
No Warranty
The Application is provided on an "as is" and "as available" basis, without warranty of any kind, whether express or implied. To the fullest extent permitted by applicable law, Platsana expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Platsana does not warrant that the Application will be uninterrupted, error-free, or free of defects. Software defects may occur from time to time, and while reasonable efforts will be made to address them, no guarantee is made as to the timeliness or completeness of any such remediation.
6. Limitation of Liability
Limitation of Liability
To the maximum extent permitted by applicable law, Platsana shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from your use of, or inability to use, the Application — including but not limited to loss of data, loss of revenue, or interruption of service.
Your use of the Application is solely at your own risk.
